Understanding Submission Terms

What rights do I retain as an artist if I submit artwork to Artocrats?

As an artist, you retain all intellectual rights and copyrights to your original artwork. By submitting your art, it is important for you to know that whether or not your image is produced as a limited edition print we retain the right to use your submitted image on our site, in promotional materials, and for other display purposes.

After 90 days, your submission will no longer be eligible to become a limited edition print. Your submission however will remain on our site until you remove it.

What rights do I retain if my submission is selected to become a limited edition print?

In order to create an exclusive product, Artocrats purchases licensing rights for any image when we intend to produce as a limited edition print. What that means for you as an artist is that for a 2 year period you cannot sell, give, or transfer reproduction rights to your original artwork to any other person or business. Even if we license your image for reproduction, you will always retain all intellectual rights and copyrights to your original artwork.

As an artist, we want you to be able to continue to profit from your labor in creating a desirable work of art. So, during our 2 year licensing period, you retain the right to produce as many reproductions of your art as you personally can make or have made, to be sold by you as an individual artist. However, this unlimited right to reproduction only applies if the prints you are selling are signed by you, the artist. Additionally, we request that any print you produce be at least 25 percent different in size from the prints we produce. If there is a very specific reason why you would need to sell unsigned reproductions, please contact us and we will work with you on how to address this need.

What will I receive if my submission is selected to become a limited edition print?

Any artist whose submission is chosen by our community to become a limited edition print will receive a choice of two forms of payment:

  • Option One: A $300 cash payment, and a gift certificate for a 3-month membership on the Artocrats site.

  • Option Two: A gift certificate for a 12-month membership on the Artocrats site, and gift certificates good for two individual prints.

Will I receive a print of my winning submission?

We do not send artists a print of their own limited edition. However, you are more than welcome to choose to receive your print with your gift certificate.

Am I allowed to submit images containing nudity?

Yes. Depictions of the human body are part of a long and respected tradition within the canon of art. That said, there are some grey areas related to this subject that should be addressed:

If we or other members of the Artocrats community suspect that a photographic image depicts a nude figure under the age of 18, the submission in question will be removed from public view without notice. During this time we may request a Model Release Form [LINK] from you in relation to such an image. We will only accept a a model release form signed by the subject with a stated date of birth. If no release is provided, the image in question will be deleted from the site.

While erotic art is acceptable in many gallery and museum settings, we do not currently have an "Adults Only" section on this site. As a result, any submission with sexually explicit content, or other content we judge to be obscene, may be removed from the site without notice.
